In order to enjoy the services offered in the vehicle social networking mobile device application known as karKango, the user of our mobile device application, karKango, must first agree to our company’s terms of service contract. These terms of service are a legally binding contract between you and karKango LLC and by agreeing to make an account on the mobile device application karKango you have agreed to the terms stated in this contract. Do not use the mobile device application karKango if you are not in agreement with the terms stated in this contract.
NON-BINDING ARBITRATION
BEFORE PROCEEDING WITH ANY LITIGATION AGAINST KARKANGO LLC AS A RESULT OF SOMETHING YOU ARE IN DISAGREEMENT WITH ON THE KARKANGO MOBILE DEVICE APPLICATION YOU WILL CONSULT WITH KARKANGO LLC ABOUT CONDUCTING A NON-BINDING ARBITRATION AGREEMENT. YOU, A USER OF THE KARKANGO MOBILE DEVICE APPLICATION, ARE REQUIRED TO CONDUCT A NON-BINDING ARBITRATION AGREEMENT WITH KARKANGO LLC BEFORE PROCEEDING TO LITIGATION UNLESS KARKANGO LLC DEEMS IT UNNECESSARY. IF YOU ARE NOT IN AGREEMENT WITH THE DECISION OF THE ARBITRATOR ELECTED IN THE NON-BINDING ARBITRATION AGREEMENT YOU MAY PROCEED TO LIGATION AGAINST KARKANGO LLC. YOU MAY OPT OUT OF THIS TERM TO CONDUCT A NON-BINDING ARBITRATION AGREEMENT WITH KARKANGO LLC WITHIN THIRTY (30) DAYS OF CREATING A KARKANGO MOBILE DEVICE APPLICATION USER ACCOUNT BY EMAILING KARKANGO LLC AT SUPPORT@KARKANGO.COM FROM THE EMAIL ADDRESS ASSOCIATED WITH YOUR USER ACCOUNT WITH THE THE TITLE “OPT OUT” IN THE SUBJECT OF YOUR SENT EMAIL. SENDING AN EMAIL WITH THE TITLE “OPT OUT” TO SUPPORT@KARKANGO.COM WILL FORFEIT YOUR ABILITY TO USE THE KARKANGO MOBILE DEVICE APPLICATION AND IT WILL THEREFORE BE AS IF YOU NEVER USED THE KARKANGO MOBILE DEVICE APPLICATION BECAUSE YOU DID NOT AGREE TO THE TERMS REQUIRED IN ORDER TO USE THE KARKANGO MOBILE DEVICE APPLICATION. IF YOU ARE NOT IN AGREEMENT WITH THESE TERMS DO NOT USE THE KARKANGO MOBILE DEVICE APPLICATION.
I. Eligibility
By using the mobile device application karKango you state that:
You are able to form a binding contract with karKango LLC.
You have at least 18 years of age.
You are not a convicted sex offender
You are not a person who is barred from receiving the Services under the laws of the United States or any other applicable jurisdiction.
You will comply with the terms in this contract as well as all applicable local, state, national, and international laws, rules, and regulations.
II. Rules of Engagement
In order for the karKango mobile device application to present a harmonious environment for users to peacefully interact with each other certain rules must be followed. Disobeying any of the rules stated below is a violation of this Terms of Service contract and by doing so you, the violator, forfeit your right to use the karKango mobile device application. By using the mobile device application karKango and disobeying the rules stated below you agree to the term of taking full responsibility for any and all consequences resulting from your actions. Moreover, disobeying the rules stated below may lead to the involvement of law enforcement and/or legal action against you depending on the severity of the consequence or consequences of the rule or rules disobeyed.
You will not promote, display, or distribute any type of nudity or pornographic content on the karKango mobile device application.
You will not harass or bully any users on the karKango mobile device application for any reason. Comments of constructive criticism, disagreement, or disappointment with a user’s vehicle or equipment on a user’s vehicle is acceptable; however, negative comments directed to the individual user of the account will be considered bullying and harassment and will not be tolerated.
You will not threaten to harm a person or damage their property.
You will not promote, display, or distribute content involving illegal activities, and you will not use the karKango mobile device application as a means to conduct illegal activities.
You are only allowed to promote or display vehicle related content in your user photos. Exceptions to this rule are given to the users of spectator profiles who are allowed to display one photo of themselves that is not required to be vehicle related.
You will not post a photo of a vehicle or vehicles if you do not have access to at least one of the vehicles in the photo. KarKango LLC defines having access to a vehicle as having in the user’s possession the key which operates the exact vehicle displayed in the photo posted.
You will not use the karKango mobile device application messaging features to send spam to users or to engage in deceptive practices.
You will not post any content that demeans, defames, or promotes discrimination or violence on the basis of race, ethnicity, national origin, religion, sexual orientation, gender identity, disability, or veteran status.
You will not post any photos containing content that you are not the owner of without the proper authorization and by using the karKango mobile device application you agree that karKango LLC is not responsible for photos posted by you or other users of the karKango mobile device application.
You will not copy, modify, distribute, sell, or lease any part of the karKango mobile device application, nor are you allowed to reverse engineer or attempt to extract the source code of the karKango mobile device application software. All rights to the karKango mobile device application software belong exclusively to karKango LLC and a violation of these rights will result in legal action against the violator or violators responsible.
Although you may follow all the rules stated above, in order to use the karKango mobile device application you must agree that karKango LLC holds zero liability for any emotional stress, harm and/or physical harm done to your body and/or property as a result of another user disobeying the rules stated above; if you do not agree to this term do not use the karKango mobile device application. You are encouraged to report users you find disobeying the rules stated above by using the karKango mobile device application report feature located in the upper right corner of the mobile device application road page or by sending a detailed email reporting the violation to support@karkango.com.
KarKango LLC has the right to delete your profile on the karKango mobile device application if you are found in violation of any of the rules stated above.
III. The Thumbnails in the Link Section
The thumbnails found under the CHAIN-LINK icon in the describe your ride section of the edit profile page found within the mobile device application are provided in order to help users of the karKango mobile device application easily communicate to other users of the mobile device application about how they choose to modify and/or maintain their vehicles, their most trusted riding equipment, and what they prefer to listen to while operating their vehicles. Copyright materials are transformed and created into small lower resolution thumbnails for users of the mobile device application to use in order to easily communicate about beliefs, genres, people, or equipment they love, support, and identify with to other users of the mobile device application. Users are able to utilize the thumbnails that are part of this unique form of communication at no cost to the users. These thumbnails are also intended to be a way for users to visually observe quickly how many similarities they share with users of the mobile device application’s very diverse user population. The use of copyright material under these conditions would be considered “fair use” under section 107 of the Copyright act. If there are questions or concerns about the improvement, addition, or deletion of thumbnails please feel free to contact us at support@karkango.com and we will do our best to fulfill your requests. Thank you.
Do not abuse the use of the thumbnails. Abusing the use of the thumbnails would be considered using the thumbnails for any reason other than conveying to other users of the mobile device application that you love, support, and possibly identify with what your selected thumbnails represent. The accounts associated with users of the karKango mobile device application that abuse their use of the thumbnails will be subject to deletion and by using this mobile device application you agree to this term. Karkango LLC is not responsible for users of the mobile device application who choose to abuse their use of the thumbnails and by using this mobile device application you understand and agree that karKango LLC holds no liability for the actions of users who abuse their use of the thumbnails. If you do not agree to these terms do not use the karKango mobile device application. If you see an account that you believe is abusing their use of the thumbnails please email support@karKango.com.
Furthermore, by using the karKango mobile device application you agree that karKango LLC is not responsible for any activities or business transactions conducted on websites that are linked to the thumbnails found within the karKango mobile device application. If you believe there are inappropriate business transactions being conducted on websites linked to thumbnails found within the karKango mobile device application please report the issue to support@karkango.com. KarKango LLC will investigate the report and remove the link between the thumbnail within the mobile device application and the disreputable website reported. By using the karKango mobile device application you agree to the term that karKango LLC is not responsible for any offensive material found within the websites linked to the thumbnails in the karKango mobile device application.
IV. Privacy
Your privacy is very important to us at karKango LLC. We will briefly go over some of the sensitive information kept on the karKango mobile device application servers that may affect your privacy.
Passwords – The password used to login into your karKango account will be kept private and will not be illegally shared with anyone outside of the karKango LLC administration. In the event that you forget your password a link to reset your password will be sent to the email address you originally used to start your karKango mobile device application account. We are sorry but under no circumstances will we be able to reset your password if you no longer have access to the email address associated with your karKango mobile device application. This is to ensure the privacies of all karKango mobile device application users are being maintained.
Email addresses – The email address associated with your karKango mobile device application account can be found in your edit profile page within the karKango mobile device application. KarKango LLC cannot help you if you have forgotten the password to log into your karKango mobile device application user account or if you do not remember the email address associated with your karKango mobile device application user account. Your email address will be kept private and will not be illegally shared with anyone outside of the karKango LLC administration.
Last four of license plate - The option to add the last four of your license plate (LFLP) is a great feature that allows users to use our search engine feature in order to find your profile on the karKango mobile device application. The LFLP search feature is ideal for using the karKango mobile device application to search and discover the karKango profiles of vehicles parked on the street. Nonetheless, the LFLP feature is completely optional and users of the karKango mobile device application may choose to not use the LFLP feature. The information pertaining to the LFLP of karKango mobile device application users will be kept private and will not be illegally shared with anyone outside of the karKango LLC administration; nonetheless, a person who sees your vehicle on the street may use your license plate numbers and the LFLP search feature in an attempt to find you on the karKango mobile device application. Note that every instant you drive your vehicle in public your license plate numbers become public information; karKango LLC can only do so much to keep the information pertaining to the LFLP of your vehicle private.

V. RESPONSIBILITY
It is your responsibility to safeguard your mobile device and ensure no one gains unauthorized access to your karKango mobile device application account. In the event that another person gains unauthorized access to your mobile device they may also gain unauthorized access to your karKango mobile device application account. If another person gains access to your karKango mobile device application as a result of you not properly safeguarding your mobile device you are still responsible for the actions conducted on the karKango mobile device application by the unauthorized user and by using the karKango mobile device application you agree to this term.
Furthermore, if a social media account external to the karKango mobile device application is linked to your karKango mobile device application account there is a possibility the unauthorized user may also gain access to your linked social media account. By using the karKango mobile device application you agree that karKango LLC is not responsible for damage done within your linked social media account as a result of someone gaining unauthorized access to your karKango mobile device application profile. As always karKango LLC is not responsible for the conduct of karKango mobile device application users regardless if it is a valid user or an unauthorized user and by using the karKango mobile device application you agree to this term.
VI. Operating Vehicles
Do not use the karKango mobile device application while operating a moving vehicle. By using the karKango mobile device application you agree you will not operate a moving vehicle while utilizing the karKango mobile device application, and by using the karKango mobile device application you agree that karKango LLC is not responsible for the consequences resulting from operating a moving vehicle while using the karKango mobile device application. Furthermore, the karKango mobile device application is used on a mobile device and utilizing a mobile device while operating a moving vehicle is against the law; DO NOT BREAK THE LAW.
VII. Conduct
Maintaining positive interactions between the users of the karKango mobile device application is very important to us at karKango LLC. It is not advised to conduct business transactions with people you have solely become familiar with by utilizing the karKango mobile device application. Business should be conducted on websites or mobile device applications that were created to function with commerce such as auction or vehicle selling websites. If you discover a user on the karKango mobile device application that may have something you are interested in purchasing ensure the user with the object or vehicle of interest directs you to a website or mobile device application that functions with commerce. No business transactions should be conducted utilizing the karKango mobile device application, and by utilizing this mobile device application you agree to the term that karKango LLC is not responsible for the consequences of any business transactions conducted on the karKango mobile device application.
We are not responsible for ensuring every user on the karKango mobile device application is honest about who they depict themselves to be nor if they are honest about what vehicle they operate. The ability to add verified social media account holder links to a user profile page is given to the users of the mobile device application in order to increase the validity of the user population. By using the karKango mobile device application you agree that karKango LLC holds zero liability for any emotional stress, harm and/or physical harm done to your body and/or property as a result of you interacting with a person or persons you met on the karKango mobile device application.
VIII. Modifications
KarKango LLC reserves the right to change any of the terms of this contract at any time and karKango LLC will inform users of the mobile device application of changes to this contract by posting a new contract on the karKango.com website with a new effective date which reflects the date the changes are implemented

IX. Deletions
KarKango LLC reserves the right to delete a karKango mobile device application user account or the content posted from a user account for any reason including but not limited to a violation of any of the terms listed in this contract. By creating an account with the karKango mobile device application you agree to the term that karKango LLC has the right to delete your user account or the data associated with your user account for any reason and if you do not agree to this term do not use the karKango mobile device application.
X. Disclaimer of Liability
To the extent permitted at law, we, karKango LLC, do not accept any responsibility for any information, content, or data that has been posted by users of the karKango mobile device application. Although we will do our best to delete problematic content that has been brought to our attention, we, karKango LLC, are not responsible for offensive material and content or copyright material and content that has been posted on the karKango mobile device application by users of the karKango mobile device application. KarKango LLC cannot control the actions of all of the users of the karKango mobile device application and karKango will not be responsible for the actions of all of the users of the karKango mobile device application; if you do not agree to this term do not use the karKango mobile device application.
